Foundation Law is a solo general practice serving Eastern Oklahoma. Wesley J. Cherry handles criminal, family, injury, and civil matters in state district court, in four tribal court systems, and in federal court.

Criminal Defense

Defense against felony and misdemeanor charges, impaired driving, controlled substance offenses, and sealing an old record. Wes began his career as an assistant district attorney for the State of Oklahoma, so a charge gets reviewed by someone who knows how the file was assembled and where that kind of file usually thins out. Family Law

Divorce, custody and visitation, support, adoption including Indian Child Welfare Act cases, and guardianship. Family matters are decided on records and deadlines while being lived through by people having one of the hardest years of their lives, and both halves of that need handling. The practical fight in a contested case usually happens early, at the temporary order stage, because those orders set the baseline everything later is measured against. More on family law.

Personal Injury

Claims for people hurt by someone else negligence, including car collisions, commercial truck crashes, wrongful death, and unsafe property conditions. Oklahoma generally allows two years from the date of injury to file suit, and in truck cases the electronic data that proves the claim can be lawfully overwritten long before that. These matters are handled on a contingency fee, so the fee comes out of a recovery rather than out of pocket. More on injury claims.

Civil Litigation

Contract disputes, property and boundary matters, business disagreements, and other civil claims for individuals and small businesses. Before anything is filed, the firm will walk through what a realistic recovery looks like, whether the other side can actually satisfy a judgment, and what the case will cost in fees and in months of your attention. Where these cases are heard

Foundation Law is admitted in Oklahoma state district courts, in the United States District Courts for the Eastern, Northern, and Western Districts of Oklahoma and the Western District of Texas, in the United States Court of Appeals for the Tenth Circuit, and in the district courts of the Chickasaw, Cherokee, Choctaw, and Muscogee (Creek) Nations. That combination matters here more than it would elsewhere in the state, because after McGirt v. Oklahoma a single incident can fall under state, tribal, or federal authority depending on where it happened and who was involved.
