What Oklahoma law provides
Oklahoma allows a claim when a death is caused by the wrongful act or omission of another, in circumstances where the person could have brought a personal injury claim had they survived. The claim is brought by the personal representative of the deceased person estate, on behalf of the surviving spouse, children, and next of kin. If no personal representative has been appointed, that appointment is generally the first procedural step.
What can be recovered
Oklahoma wrongful death damages can include medical and burial expenses, the loss of the deceased person financial support and services, the grief and loss of companionship of the surviving spouse and children, and the mental pain and anguish suffered by the deceased before death. The statute allocates categories of damages among specific survivors, which is a distinction that matters when a family is not unified.
Common circumstances
These claims arise from motor vehicle and commercial truck collisions, workplace incidents, dangerous property conditions, defective products, and negligent care. Where a death occurs on the job, workers compensation may provide benefits while a separate claim against a third party remains available.
The deadline
Oklahoma generally allows two years from the date of death to bring a wrongful death action, with shorter notice requirements where a government entity is involved. Because the claim must be brought by an appointed personal representative, the practical timeline is shorter than the statute suggests.
When there is also a criminal case
A criminal prosecution and a civil wrongful death claim are separate proceedings with different parties, different standards of proof, and different outcomes.
